Terms & Conditions

By submitting content and purchasing space in The Internet Painting, participants agree to the following terms:

 

 

1. Participant Responsibility

Participants are solely and fully responsible for any images, text, logos, graphics, trademarks, or other content they submit to the project.

By submitting content, participants represent and warrant that:

• they are at least 18 years of age, or the legal age of majority in their jurisdiction

• they have the legal capacity to enter into this agreement

• they own the rights to the submitted material, or have obtained all necessary permissions, licenses, and consents required to use and submit the material

Participants further confirm that their submission does not violate any laws or third-party rights, including but not limited to:

• copyright or intellectual property rights

• trademarks or brand rights

• privacy rights

• rights of publicity or likeness

• contractual obligations

• defamation laws

• applicable local, national, or international laws

If submitted material contains identifiable individuals, participants confirm that those individuals have granted permission for their likeness to be used.

The artist does not review, verify, or confirm the legality, ownership, or permissions associated with submitted content.

All responsibility for the legality, ownership, and use of the submitted material remains entirely with the participant.

By participating in the project, participants acknowledge that the artist cannot be held responsible for any claims, disputes, or legal actions arising from the submitted content.

Participants assume full legal responsibility for the material they provide.

 

 

 

2. License to Use Submitted Content

By submitting content to The Internet Painting, participants grant the artist a worldwide, perpetual, irrevocable, non-exclusive, royalty-free license to use the submitted material in connection with the artwork and the project.

This license allows the artist to:

• reproduce the submitted content

• display the submitted content publicly

• incorporate the content into the artwork

• translate or adapt the content into different formats if necessary for production (including printing, painting, or other artistic interpretation)

• document the artwork and its development through photographs, video recordings, and other media

• present the artwork in exhibitions, installations, and public presentations

• include the artwork in publications, press materials, catalogs, and academic or curatorial texts

• share images or documentation of the artwork through websites, social media platforms, digital archives, and other online environments

Submitted content may therefore appear within:

• the physical artwork itself

• documentation of the project

• videos or images showing the creation of the artwork

• promotional materials related to the project

• reproductions or prints of the artwork

• exhibitions or presentations of the work

However, submitted content will only be used within the context of the artwork and the documentation, presentation, or promotion of the project itself.

The artist will not use submitted content independently of the artwork or for unrelated commercial purposes outside the context of the project.

Participants understand that once their content becomes part of the artwork, it may appear in reproductions, documentation, or representations of the artwork that may circulate publicly over time.

This license is granted without limitation of time or geographic location and remains valid for the duration of the artwork’s existence and documentation.

 

 

 

3. No Ownership of the Artwork

Purchasing space in The Internet Painting does not grant participants ownership of the artwork, any portion of the artwork, or any intellectual property rights associated with it.

Participants are purchasing the opportunity to have their submitted content included within the artwork as part of the participatory process.

The completed artwork, including all physical components, panels, and assembled compositions, remains the sole and exclusive property of the artist.

All rights related to the artwork, including but not limited to:

• copyright

• reproduction rights

• exhibition rights

• distribution rights

• licensing rights

• derivative works

• documentation and publication rights

are retained exclusively by the artist.

Participation in the project does not create any form of shared ownership, partnership, co-authorship, or financial interestin the artwork.

Participants are not entitled to:

• ownership of any portion of the artwork

• royalties from the sale, exhibition, or reproduction of the artwork

• profits derived from the artwork

• compensation related to future uses of the artwork

The inclusion of submitted content within the artwork does not grant participants any claim over the physical artwork or any derivative works that may be created from it.

The artist retains full and permanent control over the artwork, including the right to:

• exhibit the artwork

• sell the artwork

• reproduce the artwork

• create prints or other reproductions

• publish images of the artwork

• include the artwork in exhibitions, publications, or other presentations

Participants acknowledge and agree that their contribution does not establish any ownership rights in the final work.

 

 

 

4. Artistic Interpretation

Participants determine the content and size of the material they submit.

However, the artist retains full and exclusive artistic control over how submitted content is translated into the artwork.

This includes, but is not limited to:

• the method used to reproduce or interpret the submission

• whether the submission is printed, painted, redrawn, altered, or otherwise translated into the physical artwork

• the materials used to reproduce the submission

• the scale and visual interpretation of the content

• the location and placement of the submission within the painting

• the spatial relationship between submissions within the artwork

Participants acknowledge that submitted images may be reinterpreted artistically as part of the creative process.

The final representation of a submission within the artwork may therefore differ from the original digital file provided by the participant.

The artist reserves the right to make adjustments necessary for the creation of the artwork, including modifications related to:

• format

• composition

• material constraints

• production methods

• artistic interpretation

Participants also understand that the placement of submitted content within the artwork is determined solely by the artist and may not correspond to any specific request or expectation.

The final appearance of the artwork emerges from the accumulation of many contributions and the artist’s interpretive decisions.

Participation in the project constitutes acceptance that the submitted content will become part of a larger artistic composition and may be subject to creative interpretation.

 

 

 

5. Platform and Content Censorship

The development of The Internet Painting may be documented and shared through online platforms, including but not limited to social media, websites, video platforms, and digital publications.

Participants acknowledge that these platforms maintain their own content policies, community guidelines, and moderation rules.

In order to comply with such policies, the artist reserves the right to modify, censor, blur, crop, pixelate, partially obscure, or omit submitted content when it appears in online documentation of the project.

This may include, but is not limited to:

• explicit imagery

• graphic or sensitive material

• politically sensitive content

• copyrighted material

• trademarks or brand imagery

• content that may violate platform guidelines

Such modifications may occur in:

• videos documenting the creation of the artwork

• social media posts

• promotional material

• online publications or press coverage

Participants understand that the way their submission appears in online documentation may differ from how it appears in the physical artwork.

Content that is partially or fully censored online may still remain present in the physical artwork.

The artist may also choose not to display certain submissions in online documentation at all if doing so could expose the project to platform moderation, removal, account suspension, or other restrictions.

Participants acknowledge that these decisions are necessary for the continued documentation and visibility of the project online.

Participation in the project constitutes acceptance of these conditions.

 

 

 

6. Indemnification

Participants agree to indemnify, defend, and hold harmless the artist, the artist’s collaborators, assistants, partners, and any affiliated parties from and against any and all claims, demands, liabilities, damages, losses, or expenses arising from the content submitted by the participant.

This includes, but is not limited to, claims related to:

• copyright infringement

• trademark violations

• misuse of logos or brand identities

• violations of privacy rights

• violations of rights of publicity or likeness

• defamation or reputational harm

• unlawful or illegal content

• unauthorized use of third-party material

Participants further agree to indemnify the artist for any legal fees, attorney costs, court expenses, settlements, or damagesresulting from claims brought by third parties in connection with the participant’s submitted content.

If any legal claim, dispute, or action arises from submitted content, the participant agrees to assume full responsibility for resolving such claims and to compensate the artist for any resulting losses or legal expenses.

Participants acknowledge that the artist acts solely as the facilitator of a participatory artwork and does not create, verify, or control the content submitted by participants.

Accordingly, the participant accepts full legal responsibility for the material they submit and agrees that the artist cannot be held liable for damages or claims resulting from such submissions.

 

 

 

7. Limitation of Liability

To the fullest extent permitted by applicable law, the artist, the artist’s collaborators, assistants, partners, and any affiliated parties shall not be liable for any damages, claims, losses, or liabilities arising from participation in The Internet Painting.

This includes, but is not limited to:

• disputes related to submitted content

• claims arising from third-party rights or intellectual property

• offensive, controversial, or objectionable content submitted by participants

• the interpretation or representation of submitted content within the artwork

• the placement or visibility of submitted content in the artwork

• technical errors or issues during the submission process

• removal, modification, or censorship of content in online documentation

• expectations regarding how submissions appear in the final artwork

Participants acknowledge that The Internet Painting is a participatory artwork involving contributions from many individuals, and the final outcome cannot be predicted or controlled.

Participation in the project is entirely voluntary and undertaken at the participant’s own risk.

To the maximum extent permitted by law, the artist shall not be responsible for any indirect, incidental, consequential, special, or punitive damages arising from participation in the project.

In no event shall the total liability of the artist exceed the amount paid by the participant for their submission.

 

 

 

8. Documentation and Public Display

Participants acknowledge and agree that The Internet Painting is a publicly documented artistic project.

The development, creation, and presentation of the artwork may be recorded, photographed, filmed, or otherwise documented throughout the duration of the project.

Such documentation may include, but is not limited to:

• photographs of the artwork

• videos documenting the creation process

• images of individual contributions

• recordings of the installation or exhibition of the artwork

• press coverage or media documentation

This documentation may be shared or published through various channels, including:

• social media platforms

• websites and digital platforms

• exhibitions and installations

• printed publications or catalogs

• press articles or media coverage

• digital or physical archives

Participants understand that their submitted content may appear as part of this documentation when it is included within the artwork.

Participants further acknowledge that images or recordings of the artwork may circulate publicly as part of the project’s documentation, promotion, or historical record.

Participation in the project constitutes consent for the artist to document and publicly display the artwork and any contributions contained within it.

Participants are not entitled to any additional compensation for the appearance of their submitted content within such documentation.

 

 

 

9. Material Permanence and Degradation

Participants acknowledge and agree that The Internet Painting is a physical artwork created using a variety of materials, techniques, and processes that may change over time.

The artist may reproduce submitted content using methods that include, but are not limited to:

• printed images

• painted interpretations

• mixed media processes

• adhesives, papers, inks, and other materials

Participants understand that these materials may naturally deteriorate, fade, discolor, distort, or otherwise change over time as part of the normal aging process of physical artworks.

Such changes may occur due to:

• exposure to light

• environmental conditions

• chemical reactions within materials

• natural aging processes

• the physical structure of the artwork

• conservation or restoration processes in the future

Participants further acknowledge that the artist does not guarantee the long-term permanence, preservation, or visibility of any individual submission within the artwork.

Over time, submitted content may:

• fade or become less visible

• partially deteriorate

• change in color or texture

• become obscured by the aging of surrounding materials

These changes are considered part of the natural lifecycle of the artwork and are consistent with the behavior of many traditional artistic materials.

Participants agree that the potential degradation or transformation of their submission does not constitute a failure of the project or a breach of these terms.

Participants waive any claims related to the fading, alteration, deterioration, or disappearance of their submission within the artwork over time.

The artist shall not be held liable for any such material changes.

 

 

10. Artwork Transformation and Future Presentation

Participants acknowledge that The Internet Painting is a modular artwork composed of multiple physical panels that together form a larger composition.

The artist retains full and exclusive authority over the future presentation, transformation, and use of the artwork.

This includes, but is not limited to, the right to:

• assemble or disassemble the artwork

• exhibit the artwork as a complete composition

• exhibit individual panels separately

• sell the artwork as a whole

• sell individual panels independently

• loan the artwork or panels to exhibitions, museums, galleries, or collectors

• reproduce the artwork in publications or prints

• adapt the presentation format of the artwork for exhibitions or installations

Participants acknowledge that the artwork may be presented differently over time, depending on curatorial, spatial, or artistic considerations.

This may include:

• displaying panels individually

• displaying groups of panels

• presenting the artwork in different physical arrangements

• exhibiting only portions of the artwork in certain contexts

Participants further acknowledge that their submitted content forms part of a larger artwork and does not grant them any control over how the artwork is presented, displayed, or distributed in the future.

The artist retains full authority over the physical artwork and any decisions related to its exhibition, sale, reproduction, or long-term presentation.

Participants waive any claims regarding how the artwork may evolve, be displayed, or be distributed over time.

 

 

11. No Refund Policy

All purchases made in connection with The Internet Painting are final and non-refundable.

By purchasing space in the artwork and submitting content, participants acknowledge and agree that their participation constitutes a voluntary contribution to a participatory artistic project.

Once a submission has been made and payment has been processed, participants are not entitled to refunds, chargebacks, or cancellations for any reason.

This includes, but is not limited to situations where:

• the participant changes their mind after submission

• the participant is dissatisfied with the artistic interpretation of their submission

• the participant is dissatisfied with the placement of their submission within the artwork

• the participant provided incorrect or unintended content

• the participant expected a different visual outcome within the artwork

• the participant’s submission appears differently than expected due to artistic interpretation or material limitations

• the participant’s submission is partially censored in online documentation due to platform policies

• the participant later decides they no longer wish to participate

Participants acknowledge that The Internet Painting is a participatory and experimental artwork, and that the final outcome is inherently unpredictable.

For this reason, participants agree that all payments represent a non-refundable contribution to the project.

Participants further agree not to initiate payment disputes, chargebacks, or reversal requests through payment providers after submitting content and completing payment.

 

 

 

10. Governing Law and Dispute Resolution

These Terms and Conditions, and any participation in The Internet Painting, shall be governed by and interpreted in accordance with the laws of the Dominican Republic, without regard to conflict-of-law principles.

Participants agree that any dispute, claim, or legal proceeding arising out of or relating to the project, these Terms and Conditions, or participation in the artwork shall be subject to the exclusive jurisdiction of the courts located in the Province of La Altagracia, Dominican Republic.

By participating in the project, participants expressly agree that:

• the courts of La Altagracia, Dominican Republic shall have exclusive jurisdiction over any disputes related to the project

• participants waive the right to bring claims in any other jurisdiction or court

• participants submit to the personal jurisdiction of the courts located in La Altagracia

Participants further agree that any dispute arising in connection with the project shall first be addressed through good faith negotiations between the participant and the artist.

If such negotiations do not resolve the dispute, the matter shall be resolved exclusively through the competent courts of La Altagracia, Dominican Republic.

Participants acknowledge that the project is administered from the Dominican Republic and agree that Dominican law shall govern all matters relating to these Terms and Conditions.

Participants also agree that any legal proceedings must be conducted individually, and not as part of a class action, collective action, or representative proceeding.

To the fullest extent permitted by law, participants waive any right to participate in class actions or collective legal claimsagainst the artist in relation to the project.
